Presenter: Jan Sanders, Director, Spokane Public Libraries and Chair, ALA Committee on Legislation
Topic: The Patriot Act and Libraries

The USA PATRIOT ACT or “Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and
Obstruct Terrorism Act of 2001' was passed by Congress in October 2001. The purpose of the Act was to enhance domestic
security against terrorism after events of September 11. Since its inception, attempts have been made to change parts of this Act.
Representative Bernie Sanders (VT) and Senator Maria Cantwell (WA) are backing changes to the Patriot Act.

Section 215 under Title 2 (Enhanced Surveillance Procedures) relates to access to records and other items under the
Foreign Intelligence Surveillance Act which directly affects libraries and bookstores. ALA, concerned about privacy and
rights of patrons and opposed to any suppression of free and open exchange of knowledge, encouraged librarians to educate
patrons about aspects of this Act that would infringe on their rights as library users. The passage of the Patriot Act caused
libraries to ensure they had a records retention policy and to determine what it said about those records.

Libraries need to develop policy and a procedure in the event they are visited by a member of a court or the FBI. Staff
should know what’s in those documents. They should also know the difference between a subpoena, court order or federal letter;
know that a library can make requests of the person asking questions and can request counsel to be present. They can call the ALA
office if there is no lawyer available at the time of the visit.

After a visit, they should review what happened with an attorney and discuss what’s been taken from the library.
However, they can’t discuss this with anyone else. Review your policy and designate a person to talk with media.
Stay calm; stay current with the laws. Be legally compliant and keep our freedom to read.

Topic: U. S. Patriot Act and libraries

Tour of the Eastern Washington Archives - Charlie Mutschler, EWU Archivist
Archives and Special Collections are housed in the basement of the EWU library. Charlie discussed the collection and showed some items.

Business Meeting
In the absence of the NGIN president, Marilyn Von Seggern opened the business meeting.
Several people from Washington attended the Spring Depository Council Meeting in St. Louis and gave us brief reports.
Herrick prepared a handout on no-fee access vs. revenue streams; future of the depository library program, authentication and digitization.
Marilyn had handouts on a CD-Rom analysis project; government documents and information literacy; and exploring census data with GIS.
